Who is responsible
Downtown Center is responsible for the personal data collected through this website. In this notice, “we” and “us” mean Downtown Center.
Address: Av. Núñez de Cáceres esq. Av. Rómulo Betancourt, Bella Vista, Santo Domingo.
For any privacy matter, write to us at info@downtowncenter.com.do.
This notice covers this website only. The stores, restaurants, cinema and other businesses inside Downtown Center are independent and handle their customers’ data under their own policies.
What we collect and why
You can browse the site without giving us any personal data. We only collect what you type into a form and the little technical data the site needs to work. We never ask for ID numbers, bank details or sensitive data.
| Form | Data | Why |
|---|---|---|
| ContactContact page | Full name and email. Optional: phone and message. | To answer your message. |
| Business enquiriesStores, offices, advertising and events | Full name and email. Optional: company or brand, phone, type of business, the details of what you need (type of space, team size, format or tentative date) and message. | To answer your enquiry, share availability and terms, and prepare a proposal. |
| Advertising requestAdvertise page | Full name, company or brand and email. Optional: phone, the assets you are interested in, dates and message. | To prepare a quote and contact you about your campaign. |
| NewsletterHome, Offers and footer | Email. Optional: your first name. We also store where on the site you signed up, the language and the date you gave consent. | To send you Downtown Center news, events and offers once we start sending the newsletter. You can unsubscribe at any time. |
| Technical dataWhen you send any form | Your IP address, temporarily. | To stop spam by limiting how many submissions are sent within a few minutes. It is not stored with your request. |
With each submission we also store the language and the page you wrote from, and a record that you accepted this notice. Our team may add internal notes and the follow-up status of your request.
Like any website, our hosting provider logs technical data for each visit (IP address, browser and page requested) to run and protect the service.
We do not use your data for personalized advertising or profiling. The newsletter is optional and separate from the other forms: we only write to you if you tick its box, and every email will include an unsubscribe link. Your email is stored in our own database; we do not share it with any email sending service or with the stores in the center.
Review build. While the site is in testing, the team uses a feedback tool. If you use it, we store your name, your comment, your email if you give it, the page and element you point at, a screenshot of the page, your screen size, browser and time zone. They are stored in a database on Render and used only by the team to improve the site.
Legal basis
We process your data with your consent, which you give by ticking “I accept the privacy notice” before sending a form. Law 172-13 requires that consent to be free, express and informed (art. 5, item 4), which is why we explain here what we do with your data.
If we later sign an agreement with you (for example, a store lease or an advertising campaign), we will use the data needed for that business relationship (art. 27, item 4).
For the newsletter, consent is the box “I agree to receive Downtown Center news, events and offers”, shown unticked next to the signup form.
You can withdraw your consent at any time by writing to us or, for the newsletter, with the unsubscribe link. Withdrawing it does not affect what we did before with your permission.
Retention
We keep form data for as long as needed to handle your request and follow up on it. When it is no longer needed we delete it, unless a law requires us to keep it or we need it to defend a legal claim.
We keep your newsletter subscription while you stay subscribed. If you unsubscribe, we keep only your email marked as “unsubscribed” and the date, so we don’t write to you again; if you would rather we delete it completely, just ask.
The IP address used against spam is not stored: it only lives for a few minutes in the server’s memory.
You can ask us to delete your data sooner at any time.
Security
- The whole site runs over an encrypted connection (HTTPS).
- Form submissions are stored in a database with no public access. Only authorized staff can get in, each with their own account.
- The forms are protected against spam and automated submissions.
No system is foolproof. If an incident affects your data, we will act to contain it and let you know when appropriate.
Your rights
The Dominican Constitution recognizes your right to access your data and to know how it is used (art. 44, item 2), and Law 172-13 on personal data protection sets out how to exercise it. You have the right of:
How to exercise them
Write to us at info@downtowncenter.com.do saying which right you want to exercise. We may ask you to confirm your identity. It is free, and each right is independent: you don’t need to exercise one to request another (art. 9).
We answer access requests within 5 business days (art. 10) and correct, update or delete data within 10 business days (art. 8). When we delete data, it may stay blocked for a while if a law requires us to keep it (arts. 8 and 15).
If we do not answer in time or you disagree with our answer, you can go to court through a habeas data action (Constitution, art. 70; Law 172-13, arts. 8 and 17).
Children
The site’s forms are for enquiries from adults. We do not knowingly collect data from minors. If you are under 18, ask a parent or guardian to write to us for you.
If we learn that we received a minor’s data without authorization, we delete it. Processing of minors’ data is governed by the Code for the Protection of the Rights of Children and Adolescents (Law 172-13, art. 79).
International transfers
This site’s servers are outside the Dominican Republic: the site and the forms database are hosted in the United States (Render). The third-party services mentioned in this notice may also process data in other countries.
Law 172-13 allows these transfers when you consent or when they are needed for pre-contract steps you request (art. 80, items 1 and 6). By accepting this notice and sending a form, you authorize your data to be stored on those servers.
Changes to this notice
We may update this notice when the site or the law changes. We will publish the new version on this page with its date. If the change is significant, such as a new use of your data, we will highlight it on the site and, when appropriate, ask for your permission again.
